Terms of Use — Forage

1. Agreement to Terms
By downloading, installing or using the Forage mobile application ("Forage", "the app", "the service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use Forage.
Forage is operated by Byron Adu, ABN 64 481 958 542, based in Australia ("we", "us", "our").
2. The Forage Service
Forage is an AI-powered cooking application that allows users to:
- Upload photos of their kitchen, fridge or pantry
- Receive AI-generated ingredient identification based on those photos
- Receive personalised recipe suggestions based on identified ingredients
- Save recipes, manage a shopping list and store pantry staples
Forage uses artificial intelligence to generate recipe suggestions. All recipes are AI-generated and are intended as inspiration only. We do not guarantee the accuracy, completeness or suitability of any recipe for your individual circumstances.
3. Accounts
3.1 Creating an account To use Forage you must create an account using a valid email address and password, or by signing in with your Google account. You must be at least 13 years of age to create an account.
3.2 Account responsibility You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at contact@forageit.com if you suspect any unauthorised use of your account.
3.3 Accurate information You agree to provide accurate, current and complete information when creating your account and to keep this information up to date.
4. Subscriptions and Payments
4.1 Free trial New users receive a 7-day free trial of Forage Premium. No charge is made during the trial period. You may cancel at any time before the trial ends without being charged.
4.2 Subscription After the free trial, your subscription will automatically renew at the applicable subscription price unless you cancel before the renewal date. Subscription pricing is displayed within the app and may be updated from time to time with reasonable notice.
4.3 Free tier If you cancel your subscription, your account will revert to the Forage free tier. The free tier includes limited scans per day and restricted access to certain recipe tiers. Full details of what is included in each tier are displayed within the app.
4.4 Payment processing All payments are processed by Google Play Billing (Android) or Apple StoreKit (iOS). Forage does not store your payment details. Refunds and billing disputes are handled in accordance with Google Play or Apple's policies.
4.5 Cancellation You may cancel your subscription at any time through your Google Play or Apple account settings. Cancellation takes effect at the end of the current billing period.
5. Acceptable Use
You agree to use Forage only for lawful purposes and in accordance with these Terms. You agree not to:
- Use Forage in any way that violates any applicable Australian or international law or regulation
- Upload photos that contain illegal content, explicit material, or content that violates the rights of any third party
- Attempt to gain unauthorised access to any part of Forage or its related systems
- Use automated means to access or interact with Forage without our express written permission
- Reverse engineer, decompile or disassemble any part of the Forage application
- Use Forage for commercial purposes without our prior written consent
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Attempt to interfere with the proper functioning of Forage or its servers
6. Photos and Content You Upload
6.1 Your content You retain ownership of any photos you upload to Forage. By uploading photos, you grant us a limited, non-exclusive licence to process those photos using our AI services for the sole purpose of providing the Forage service to you.
6.2 Content standards You agree that photos you upload will only contain images of food, kitchen items, pantry contents or ingredients. You agree not to upload photos containing people, private or sensitive information, or any content that would be inappropriate, offensive or unlawful.
6.3 No permanent storage Photos you upload are processed in real time. We do not permanently store your photos beyond what is necessary for your scan history as described in our Privacy Policy.
7. Intellectual Property
7.1 Forage IP All intellectual property in the Forage application — including but not limited to the name "Forage", the logo, design, code, colour scheme, user interface and AI prompts — is owned by or licensed to us. Nothing in these Terms grants you any right to use our intellectual property without our prior written permission.
7.2 Recipe content Recipes generated by Forage are AI-generated outputs produced for your personal use. You may use these recipes for personal, non-commercial purposes. You may not reproduce, distribute or commercialise AI-generated recipes from Forage without our prior written consent.
8. Disclaimers and Limitations
8.1 AI-generated content Forage uses artificial intelligence to identify ingredients and generate recipes. AI systems are not infallible. We do not guarantee that ingredient identification will be accurate or complete, and we do not guarantee that recipes will be suitable for your dietary needs, health conditions or personal circumstances.
8.2 Allergy and dietary information Forage is not a medical or dietary advice service. Recipe suggestions generated by Forage may not account for all allergens or dietary requirements. If you have serious food allergies, intolerances or medical dietary requirements, you must independently verify the suitability of any recipe before preparing or consuming it. We accept no liability for any adverse reactions or health outcomes arising from recipes generated by Forage.
8.3 Service availability We do not guarantee that Forage will be available at all times or that it will be free from errors or interruptions. We reserve the right to modify, suspend or discontinue the service at any time with reasonable notice where possible.
8.4 Limitation of liability To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use Forage. Our total liability to you for any claim arising from your use of Forage shall not exceed the amount you paid to us in subscription fees in the 12 months preceding the claim.
Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded by agreement.
9. Privacy
Your use of Forage is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy carefully to understand how we collect, use and protect your personal information.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice within the app or by email. Your continued use of Forage after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using Forage.
11. Termination
11.1 By you You may stop using Forage and delete your account at any time through the app settings.
11.2 By us We reserve the right to suspend or terminate your account if you breach these Terms, engage in fraudulent or abusive behaviour, or for any other reason at our discretion with reasonable notice where possible. If we terminate your account without cause, we will refund any unused portion of your current subscription period.
12. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of Forage will be subject to the exclusive jurisdiction of the courts of Australia.
